Sirs: In Pension Claim of Anna Stevens, widow of Zachariah Stevens under Act of Feby 14 1871 No. 4935, the evidence filed to prove marriage by cohabitation is insufficient. The fact of claimant and soldier living together as husband and wife, prior to February 17, 1815, must be clearly proven by witnesses who were at that time of sufficient age to testify intelligently to such cohabitation. A copy of a record kept in the family for the purpose of preserving the dates of marriage births and deaths will be considered in examining the claim. Such record must be sworn to by the claimant and the Copy Certified by the officer to be a correct transcript and the original genuine in its appearance.
